1. Agreement to Terms
By accessing or purchasing from Dymond Coatings (“we,” “us,” “our”), you (“you,” “Customer,” “Installer,” or “Buyer”) agree to these Terms of Sale and Use. If you do not agree, do not use this website or place an order.
These terms govern all purchases, including any implied warranties, disclaimers, and limitations of liability.
2. Intended Use & Installer Responsibility
Our products are professional-grade materials intended for use by trained professionals. The installer assumes full responsibility for:
- Proper substrate prep (e.g. CSP level, moisture, contaminants)
- Ambient conditions (temperature, humidity, dew point)
- Correct mixing, thickness, and installation methods per Technical Data Sheets (TDS)
- Compatibility with substrate and topcoats
- Performance in the target environment
Mixing & Use Restrictions
Products must be mixed only with their corresponding components supplied within the same kit and strictly in accordance with the stated mix ratios and instructions. Mixing components from different products, kits, or batches, or altering ratios, is strictly prohibited and will result in product failure. Any such use is undertaken entirely at the user’s risk and voids all warranties, support, and liability.
Verification Requirement
In the event of any claim relating to product performance or failure, the Customer may be required to provide evidence of correct surface preparation, environmental conditions, mixing ratios, and application methods. Failure to provide sufficient supporting evidence may result in the claim being denied.
We do not warrant installation outcomes, even if product instructions are followed. Misuse or deviation from provided documentation voids any available support or remedy.
3. Product Limitations
Products may vary in appearance, color, gloss, or batch consistency. Application conditions - including lighting, substrate variation, mixing accuracy, and environmental humidity - can affect final results. Physical properties listed in documentation are typical, not guaranteed.
Products may:
- Yellow in UV exposure
- Wear over time under abrasive traffic
- Fail due to improper prep, moisture, or mixing
- Require field testing to confirm suitability
Failure to strictly follow mixing instructions, including correct component pairing and ratios, is a leading cause of product failure and is not considered a product defect.
Each buyer is responsible for testing and verifying performance for their specific project before full application.
4. Limited Warranty
Dymond Coatings warrants only that its products conform to published specifications at the time of shipment. If a product is found to be defective, we may offer:
- A replacement of the affected product, or
- A refund of the original purchase price (exclusive of shipping)
This warranty is void if:
- Installation guidelines were not strictly followed, including but not limited to incorrect mixing ratios, combining components from different kits or products, improper environmental conditions, or deviation from Technical Data Sheets (TDS)
- Product was applied to an improper substrate or condition
- Failure results from moisture vapor, substrate movement, chemical abuse, UV exposure, or physical damage
We do not cover labor, downtime, equipment, or installation costs. This is a product-only warranty.
All other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose, are expressly disclaimed to the fullest extent allowed by law.
5. The Dymond Lifetime Promise
Our "Lifetime Promise" is a customer satisfaction pledge, not a legal warranty.
It applies only to products installed according to Dymond instructions and maintained under reasonable use. Where a verifiable product defect exists, we may, at our sole discretion, offer partial or full replacement.
This Promise does not apply to:
- Damage caused by moisture, UV exposure, freeze/thaw, abuse, or negligence
- Systems altered, mixed, or substituted with non-Dymond products
- Cosmetic issues, gloss loss, fading, or normal wear
The “lifetime” refers to the reasonable expected life of the installed system under normal conditions. It is not the life of the owner or building.
6. Returns & Refunds
All sales are final unless a defect is reported within 14 days of delivery. Custom-tinted or mixed products are not eligible for return.
If a return is approved:
- Products must be unopened, unused, and in resalable condition
- Returns must be shipped at the buyer’s expense
- A restocking fee may apply
7. Limitation of Liability
To the fullest extent allowed by law, Dymond Coatings shall not be liable for any:
- Indirect or consequential damages
- Labor or installation costs
- Business interruption or delay
- Property damage or personal injury resulting from product use or misapplication
Under no circumstances shall Dymond Coatings be responsible for costs associated with removal, remediation, or reinstallation of any applied product.
Our maximum liability is strictly limited to the original purchase price of the specific product giving rise to the claim.
8. Indemnity
You agree to defend and indemnify Dymond Coatings against all claims, losses, damages, or expenses (including legal fees) arising from your misuse of products, improper installation, or failure to follow applicable instructions or laws.
9. Use of Site
You agree not to misuse this website, attempt unauthorized access, or interfere with its operation. We reserve the right to restrict or terminate your access at any time for any reason.
10. Intellectual Property
All trademarks, product names, and content on this site are the property of Dymond Coatings and may not be copied, reproduced, or redistributed without written permission.
11. Third-Party Links
Any links to third-party sites are provided for convenience only. We are not responsible for the content, privacy practices, or terms of those external websites.
12. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes shall be resolved exclusively in Knox County, Tennessee.

Claims submitted without complete order details, batch information, photos, and sufficient documentation of surface preparation, mixing, and application conditions may not be reviewed or may be denied.

We reserve the right to modify these Terms at any time. The version in effect at the time of your purchase governs that transaction.
